General Terms and Conditions

I. Basic provisions

These General Terms and Conditions (hereafter referred to as the "GTC") govern the relations between the contracting parties (contracts for the provision of services), where on one side is the company Jeseniova 49 s.r.o., IČ 210 50 465, VAT number CZ21050465, with registered office at Plzeňská 155/113, 155 00 Prague 5, registered in the commercial register maintained by the Municipal Court in Prague, section C, file 396194 as the operator of the Design Merrion Hotel and the seller (hereafter referred to as the "Hotel" or the "Seller") and on the other hand is the customer/guest (hereafter referred to as the "Buyer" ). The buyer is a consumer or entrepreneur. If the Buyer states his identification number in the order or when making a reservation, he acknowledges that the rules intended for entrepreneurs apply to him. Conversely, if the buyer does not provide any identification number, it is assumed that the buyer is a private consumer. By placing an order, making a reservation, or making a purchase on the online shop of the website, the buyer confirms that he has familiarized himself with these Terms and Conditions and the Terms of Personal Data Protection before concluding the contract and that he expressly agrees with them, as amended and effective at the moment of confirmation of the order or reservation made in the online shop.

An invoice containing the basic details of the contract, incl. receipts according to the Act on the Registration of Sales and Tax Document, will be received by the Buyer in the form of a link to download the invoice or as an attachment in an e-mail sent to the specified e-mail address when booking, ordering or purchasing services. The buyer agrees to this.

II. Contract

1. Conclusion of the contract
Before the Buyer bindingly confirms the order, the Buyer has the right and option to change both the required performance and the payment method, i.e. check all the data he entered in the order/reservation. The purchase contract is created by sending the order/reservation by the Buyer after choosing the payment method and accepting the order from the Hotel. The Hotel will immediately confirm the conclusion of the contract to the Buyer by sending an informative email to the email entered by the Buyer. The resulting contract (including the agreed price) can be changed or canceled only based on the agreement of the parties or based on legal reasons unless otherwise stated in the General Terms and Conditions.

The concluded contract is archived by the seller for at least five years from its conclusion, but no longer than for the period according to the relevant legal regulations, for its successful fulfillment, and is not accessible to third parties. Information about the individual technical steps leading to the conclusion of the contract can be seen from these terms and conditions, where this process is clearly described.

2. Provision of ordered services
With the purchase contract, the Hotel undertakes to provide/provide the Buyer with the ordered services that are the subject of the purchase, and the Buyer undertakes to use ordered services according to the scope and to pay the purchase price to the Hotel. The hotel reserves the right to confirm to place an order for services to the Buyer only after full payment of the purchase price.

3. Withdrawal from the contract by the buyer
The buyer has the right to withdraw from the contract at any time before the start of the services under the conditions governed by the Hotel cancellation policy at the time of the conclusion of the contract following the selection of the Hotel's price offer. If the client is entitled to a refund of the amount paid as part of withdrawal from the contract, the hotel proceeds as follows:
a. if possible, the hotel will return the funds in the same manner in the same form that the hotel received them
b. returns the funds in an alternative agreed-upon manner confirmed by both parties
c. will keep funds as credit for future use of services; in this case, the agreement of both parties is needed and the replacement drawdown must be used in the same year
In case of payment of the credit note in cash, the Hotel may require the presentation of an identification card (OP or passport), to prevent damage and the legalization of proceeds from criminal activity. Without submitting the mentioned documents, the Hotel may refuse to reimburse funds.

4. Withdrawal from the contract by the hotel
The hotel is entitled, to withdraw from the contract in case of an obvious error in the price of the services, except in cases stipulated by law.
It is possible to withdraw from the contract according to this point within 7 days, if the use of the ordered services is reserved for later than 7 days from the order, from the day following the day of the conclusion of the purchase contract between the Buyer and the Hotel, by the Hotel canceling the Buyer's order or giving it to another way to make it clear that he withdraws from the contract
If the Buyer has paid at least part of the purchase price of the services, this amount will be transferred back to his bank account, no later, than 14 days from the day following the day of withdrawal from the contract by the Hotel.


III. Security and protection of personal data

The protection and processing of the Buyer's data by the Hotel is governed by the terms and conditions on the protection of privacy and information on the processing of personal data (GDPR)

IV. Opening hours

Orders (reservations) via the Hotel's internet portal are possible 24 hours a day, 7 days a week. In the event of a reservation failure

V. Prices

All prices are negotiable. On the website there are always up-to-date and valid prices in the single currency EUR. The prices listed for individual products are final, i.e. including VAT. If a contract containing a specific price list is concluded between the buyer and the Hotel, this has priority over the prices published on

The prices listed on the hotel's website are calculated in EUR and an approximate conversion into Czech currency is possible and is only for orientation. The binding price and currency are always stated in the service order confirmation. To convert amounts between EUR and CZK, the Hotel uses an internally determined exchange rate.

The final price includes all mandatory surcharges, the Buyer is obliged to pay extra on the spot, for example, the local tourist tax.

The hotel reserves the right to declare the purchase contract invalid if there has been misuse of personal data, abuse of a payment card, etc., or due to the intervention of an administrative or judicial authority - the Buyer will be informed of such a procedure.

VI. Payment Terms

The hotel accepts the following payment terms:
Services provided by the Hotel must be fully paid for before the start of using such services, unless otherwise contractually stipulated
When confirming the order, a guarantee with a valid credit or debit card valid on the day the service starts is required, unless otherwise contractually stipulated.
The Buyer's invoicing data cannot be changed retroactively after the order has been sent
The hotel reserves the right to offer the Buyer only selected payment methods at its discretion.

Online payments via payment gateway
The hotel also accepts online payments, which can be processed by redirecting to the payment gateway when making a reservation on the hotel's official website, or during payment instructions with an active link to the payment gateway.

Never make a payment unless you are sure that the instruction for such payment was clearly initiated by the hotel.

The Hotel reserves the right after the successful execution of the payment transaction to keep the details of the payment card for the necessary time and possibly use them for an additional payment to which a claim may arise if the payment transaction carried out does not cover the total value of the services and fees to which the Hotel is entitled. These are usually, for example, cancellation fees according to the cancellation conditions in case of cancellation of the reservation or no-show without prior cancellation.

The buyer is responsible for the correctness of the data for the refund, if he is entitled to such a refund and has chosen option II. 3. of these terms and conditions

VII. Cancellation Policy

The amount of the fee depends on the type of accommodation services ordered. This kind is distinguished by the name - type of price. The cancellation policies are always stated in the price description when choosing the date and type of reservation, and we are bound by them.

VIII. Final Provisions

Relationships and any disputes that arise based on the contract will be resolved exclusively according to the law of the Czech Republic and, will be resolved by the relevant courts of the Czech Republic. Any disputes between the Hotel and the Buyer can also be resolved out of court. In such a case, the Buyer can contact, for example, the Czech Trade Inspection. The contract is concluded in the Czech language. If the translation of the contract, is created for the buyer's needs, the interpretation in the Czech language applies in case of a dispute over the interpretation of terms.
